This method of study causes the microscopic observation of the internal angles of literary texts; Therefore, in order to get to know an author as well as possible, interdisciplinary review and criticism of that text is necessary. In this essay, considering the importance of legal issues in the formation of exciting literary stories and also the role of literature in introducing legal principles, the reflection of the provisions of the Declaration of Human Rights in the fictional works of one of Iran"s modernist writers, Shahriar Mandanipour, is investigated. METHODOLOGY: The study method in this article is analytical-descriptive and the data collection method is library studies. In this essay, the general atmosphere, history, and concept of human rights are first introduced, and then the theoretical foundations and main materials of human rights are used in the analysis of Shahriar Mandanipour"s works. For this purpose, all fiction works of this author have been studied and reviewed. FINDINGS: Based on the findings of this article, among the most important provisions of human rights that Mandanipour ordered his audience to observe, freedom and equality in terms of dignity and rights; the right to freedom and personal security; prohibition of torture, punishment, cruel, inhuman or degrading treatment; equality before the law; The right to travel and reside freely in other countries; The right to asylum in another country against torture, persecution and harassment; The right to marry at legal age without any restrictions on race, nationality, or religion; the right to freedom of opinion and expression; The right to a decent life, health and well-being; And the right to education is universal (ten principles). CONCLUSION: More than any principle, Mandanipour has addressed the principle of "the right to a decent life, health and well-being". Of course, he has a pessimistic view and position on these issues and actually has no hope for the implementation of human rights in the current world, especially in the third world and especially in the Middle East.زمینه و هدف: یکی از روشهای علمی و اثبات‌شدۀ نقد و بررسی متون ادبی، مطالعۀ بینارشته ای این آثار است؛ تحلیل متون ادبی بر مبنای مطالعات حقوقی و جامعه شناسانه، یکی از انواع مهم مطالعات بینارشته ای میباشد. این روش مطالعه، سبب رصد ریزبینانه و موشکافی هرچه دقیقتر زوایای داخلی متون ادبی میشود؛ بنابراین برای شناخت هرچه بهتر یک نویسنده، بررسی و نقد بینارشته ای آن متن ضروری مینماید. در این جستار با توجه به اهمیت مباحث حقوقی در شکلگیری داستانهای مهیج ادبی و همچنین نقش ادبیات در شناساندن اصول حقوقی، به بررسی انعکاس مفاد اعلامیۀ حقوق بشر در آثار داستانی یکی از نویسندگان مدرنیست ایران، شهریار مندنی‌پور، پرداخته میشود. روش مطالعه: روش مطالعه در این مقاله، تحلیلی-توصیفی و روش گردآوری داده ها مطالعات کتابخانه ای میباشد. در این جستار ابتدا با فضای کلی و تاریخچه و مفهوم حقوق بشر آشنا شده و سپس مبانی نظری و مواد اصلی حقوق بشر در تحلیل آثار شهریار مندنی‌پور به کار گرفته شده است. بدین منظور تمام آثار داستانی این نویسنده مورد مطالعه و بررسی قرار گرفته است. یافته ها: بر اساس یافته های این مقاله از جمله مهمترین مفاد حقوق بشر که مندنی‌پور مخاطبان خود را به رعایت آنها سفارش کرده است، آزادی و برابری از لحاظ حیثیت و کرامت و حقوق؛ حق آزادی و امنیت شخصی؛ ممنوعیت شکنجه، مجازات، رفتار ظالمانه، ضد انسانی یا تحقیرآمیز؛ برابری در مقابل قانون؛ حق رفت‌وآمد و اقامت آزادانه در دیگر کشورها؛ حق پناهندگی در کشوری دیگر در برابر شکنجه، تعقیب و آزار؛ حق زناشویی در سن قانونی بدون هیچ محدودیتی از حیث نژاد، ملیت، یا دین؛ حق آزادی عقیده و بیان؛ حق برخورداری از زندگی مناسب و سلامت و رفاه؛ و حق برخورداری از آموزش و پرورش همگانی است (ده اصل). نتیجه گیری: مندنی‌پور بیش از هر اصلی، به اصل «حق برخورداری از زندگی مناسب و سلامت و رفاه» پرداخته است. البته او نگاه و موضعی نومیدانه به این مباحث دارد و در واقع امیدی به اِعمال و اجرای حقوق بشر در جهان کنونی ندارد، بویژه در جهان سوم و بویژه در خاورمیانه.حقوق بشر, قانون, ادبیات داستانی, مدرنیسم, رمان, شهریار مندنی‌پورhuman rights, law, fiction, modernism, novel, Shahriar Mandanipourhttps://bahareadab.com/downloadPDF/1746.pdfhttps://bahareadab.com/downloadPDF/1746.pdfhttps://bahareadab.com/article/بررسی جلوه های حقوق بشر در آثار شهریار مندنی‌پورhttps://bahareadab.com/en/article/Examining the manifestations of human rights in the works of Shahriar Mandanipour
