The motivation for creating stories is to escape from the death penalty; A lady tells Shahriar a story every night to save her life and other girls and postpones his punishment. The fear of death and punishment has cast a shadow on many stories, but it is so artistically placed in the heart of the stories that it is not noticeable. METHODOLOGY: This research is descriptive-analytical based on library studies. The research community has also done a two-volume translation of the book " One Thousand and One Nights " by Marashipour to examine the types of punishment in the stories of its two volumes. FINDINGS: In the stories of the book, we see many actions that deserve punishment. Such as treason, theft, false testimony, disbelief and atheism, misrepresentation, Conspiracy, and planned punishments, among others. CONCLUSION: The punishment for treason is death, whether it is in an unconventional romantic relationship or, in court and social relationships. Issuing a sentence and executing it is at the command of the ruler, judge, and even incompetent people such as fathers, husbands, brothers, women, or supernatural beings, among which we can mention giants, demons, and talking animals. These creatures punish criminals with unconventional methods or transformations. Belief in divine punishment is seen in stories that have a stronger religious aspect. The role and wide presence of women in the process of stories and the formation of events is worthy of reflection. Due to the cultural differences that are rooted in the origin of the stories, there is no unity of procedure and the same approach in determining and implementing the punishment; Based on the text of the story and expediency, the punishments can be reduced. The lack of a fair trial, not giving the accused a chance to defend himself, the execution of sentences, and punishments that do not fit the crime are also seen in the stories.زمینه و هدف: هزارویک‌شب، کتابی درباری، مردمی، تعلیمی و تخیّلی است با نمونه هایی فراوان از گناه و مکافات. انگیزۀ خلق حکایات، فرار از مجازاتِ مرگ است؛ بانویی که برای نجات جان خود و دیگر دختران، هر شب، قصّه ای برای شهریار میگوید و مجازاتش را به تعویق می اندازد. ترس از مرگ و مجازات، بر بسیاری از داستانها سایه افکنده است، امّا آنچنان هنرمندانه در دل داستانها نشسته که به ‌چشم نمی‌آید. روش پژوهش: این پژوهش به روش توصیفی‌ـ‌تحلیلی، بر مبنای مطالعات کتابخانه ای است. جامعۀ تحقیق نیز، ترجمۀ دو جلدی مرعشی پور از کتاب هزارویک‌شب با هدف بررسی انواع مجازات در حکایاتِ دو جلد آن انجام شده ‌است. یافته ها: در حکایات کتاب، شاهد اعمال بسیاری هستیم که مستحق مجازات است. مانند خیانت، سرقت، گواهی دروغ، کفر و الحاد، پیکرگردانی، توطئه، قانون‌گریزی، مجازاتهای برنامه ریزی‌شده و نظایر آن. نتیجه گیری: مجازاتِ خیانت، چه از نوع رابطۀ نامتعارف عاشقانه باشد و چه در روابط درباری و اجتماعی، مرگ است. صدور حکم و اجرای آن، به فرمان حاکم، قاضی و حتّی افراد بی‌صلاحیّت مانند پدر، شوهر، برادر، زنان یا جزادهندگان ماورایی است که از میان آنها میتوان به غول، جن و حیوانات سخنگو اشاره کرد. این موجودات، با روشهای نامتعارف یا پیکرگردانی، مجرمان را مجازات میکنند. اعتقاد به نزول عذاب الهی در داستانهایی که جنبۀ دینی قویتری دارند، مشاهده میشود. نقش و حضور گستردۀ زنان در روند حکایات و شکل‌گیری حوادث، قابل تأمل است. به علّت تفاوتهای فرهنگی که ریشه در خاستگاه داستانها دارد، در تعیین و اجرای مجازات، وحدت رویّه و رویکرد یکسان یافت ‌نمیشود؛ براساس متن داستان و به مصلحت، مجازاتها قابل تقلیل هستند. نبود محاکمۀ عادلانه، ندادن فرصت دفاع به متهّم، اجرای احکام و کیفرهایی که با جرم تناسب ندارند نیز در حکایات دیده ‌میشود.ادبیّات عامه, قصّه, هزارویک‌شب, مجازات, جرم و گناه.One Thousand and One Nights, folk fiction literature, story, oral literature, punishment and politics, crime and guilthttps://bahareadab.com/downloadPDF/1731.pdfhttps://bahareadab.com/downloadPDF/1731.pdfhttps://bahareadab.com/article/بررسی و تحلیل مجازات در هزارویک‌شب و تأثیر ابعاد فرهنگی‌ـ‌اجتماعی آنhttps://bahareadab.com/en/article/Study and Analysis of Punishment in One Thousand and One Nights and its Cultural-Social Impacts
