Based on this, in the forward research, the aim is to deal with the two sharia categories of theft and drinking alcohol and related rulings in the poetry of these poets, and finally, examine Islamic jurisprudence from a new perspective and with a poetic attitude. put The main question of the research is, what concepts have Sanai and Saadi explained and made available to the audience by using the mentioned jurisprudential terms? METHODOLOGY: This research was done based on library sources and descriptive-analytical method. FINDINGS: The words of Sana"i and Saadi are full of direct and indirect references to Shari"a boundaries, and they have used every expression, including Shari"a terms, to express their opinions. As a result, all the examples used in their poems, which contain concepts related to theft and drinking alcohol, do not have a jurisprudential function and have a multifaceted aspect. CONCLUSION: Conclusion: The mentioned poets have tried to provide their mystical and moral messages to their audience by using the capacities of the concepts and terms related to the Shariah limits, and therefore, their poems in most cases are not through the gate of jurisprudence. It can be analyzed and analyzed from a literary and mystical perspective.زمینه و هدف: سنایی و سعدی در اشعار خود بارها از مسائل شرعی و فقهی سخن گفته اند و بخشی از رویکردهای خود را در زمینه های گوناگون با تکیه بر این مسائل و ابعاد وسیع معنایی آن، تبیین نموده اند. بر این پایه، در پژوهش پیشرو، هدف آن است که به دو مقولۀ شرعی سرقت و شرب خمر و احکام مربوط به آن، در شعر این شاعران بپردازد و در نهایت، فقه اسلام را از دریچه ای جدید و با نگرشی شاعرانه، مورد بررسی قرار دهد. سؤال اصلی تحقیق این است که سنایی و سعدی با کاربست اصطلاحات فقهی مذکور چه مفاهیمی را تشریح کرده و در اختیار مخاطبان قرار داده اند؟ روشها: این پژوهش با استناد به منابع کتابخانه ای و روش توصیفی- تحلیلی انجام شده است. یافته ها: کلام سنایی و سعدی، مملو از اشارات مستقیم و غیرمستقیم به حدود شرعی است و آنان برای بیان مافی الضمیر خود، از هر ابرازی، از جمله اصطلاحات شرعی بهره برده اند. در نتیجه، همۀ نمونه های بکار رفته در اشعار آنها که حاوی مفاهیم مربوط به سرقت و شرب خمر است، دارای کارکرد فقهی نیست و جنبه ای چندوجهی دارد. نتیجه گیری: شاعران مذکور، سعی کرده اند با بهره گیری از ظرفیتهای مفاهیم و اصطلاحات مربوط به حدود شرعی، پیامهای عرفانی و اخلاقی خود را در اختیار مخاطبانشان قرار دهند و از اینروی، اشعار آنها در بیشتر موارد، نه از دریچۀ فقاهت، بلکه از دریچۀ ادیبانه و عارفانه، قابل تحلیل و بررسی است.سنایی, سعدی, شعر, احکام شرعی, فقه.Sana'i, Saadi, poetry, Sharia rulings, jurisprudencehttps://bahareadab.com/downloadPDF/1623.pdfhttps://bahareadab.com/downloadPDF/1623.pdfhttps://bahareadab.com/article/بررسی احکام شرعی سرقت و شرب خمر در اشعار سنایی و سعدی و تفاوتها و شباهتهای آنهاhttps://bahareadab.com/en/article/Examining the sharia laws of stealing and drinking alcohol in Sanaei and Sa’di poems and their differences and similarities
